How Lafayette Bench Warrants Are Issued

The 15th Judicial District Court covers Lafayette, Acadia, and Vermilion parishes. Judges issue bench warrants under La. C.Cr.P. Art. 349.1 when defendants miss court. This is different from arrest warrants under La. C.Cr.P. Art. 202. Bench warrants come from the judge's authority over the case, not from a police investigation. They are tied to an existing court case where the defendant failed to comply.

Warrants do not expire in Louisiana. La. C.Cr.P. Art. 205 is clear on this point. A bench warrant stays active until it is served, the person surrenders, or the court recalls it. La. C.Cr.P. Art. 203 specifies what must be on the warrant: the subject's name, the offense, the issuance date, and the judge's signature. In Lafayette Parish, bench warrants show up in booking reports as "Warrant/Bench Warrant" with the arresting agency listed. Multiple agencies operate in the parish, including the Lafayette Parish Sheriff's Office, Lafayette City PD, and other local departments. Any of them can execute a bench warrant.

Resolving Lafayette Parish Bench Warrants

Clearing a bench warrant means appearing before the 15th JDC judge who issued it. An attorney can file a motion to recall the warrant. Voluntary surrender is always the preferred route. Judges view it more favorably. The Lafayette Parish Clerk of Court at 800 S Buchanan Street, phone (337) 291-6400, handles case information and can provide details about bond requirements for specific bench warrants.

La. C.Cr.P. Art. 211.1 allows summons and release in some misdemeanor situations. La. C.Cr.P. Art. 336 covers bail procedures. Bond amounts depend on the original charge. Some bench warrants let you post bond at the LPCC. Others require a hearing. The VINE (Victim Information and Notification Everyday) system is also available through the Community Portal for victim notification purposes.

R.S. 44:32, typically $0.50 to $1.00 per page. The sheriff's office also provides a Daily Arrest Report subscription through its website, which lists all recent arrests including those made on bench warrants. La. C.Cr.P.
